Informed Consent From Parents

In order for schools to conduct an evaluation of a student (for possible special eduation services), parental consent* must be obtained.  The school must notify the parent in writing, and obtain a written signature approving the evaluation.  The parent must be informed (on the form) of the tests and procedures that will be used and why (meaning area of functioning they are used to evaluate...social skills, math, reading, behavior, etc.).  After the evaluation process is completed, the school must work with the parent to arrange a convenient time and place (for the parent) for a meeting to discuss the results and the implications.  The parent has a right to a copy of all documents related to the assessment.
 

* "Consent" means that:

(1)  "The parent has been fully informed of all information  relevant to the activity for which consent is sought, in his or her dominent language, or other mode of communication.

(2) The parent understands and agrees in writing to the  carrying out of the activity for which his or her consent is sought, and the consent describes that activity and list the records (if any) which will be released and to whom;

and

(3) The parent understands that the granting of consent is voluntary and may be revoked at any time."

A "surrogate parent" may be appointed if the student's parent/guardian is not in his/her life.
